1. Who we are

DiwAI (the “Service”) is run by NowVector Ltd, trading as DiwAI, a company registered in Scotland (company number SC900740), registered office: Office 576, 18 Young Street, Unit LGE, Edinburgh, EH2 4JB (“we”, “us”). You can contact us at support@nowvector.world. By buying or using the Service you agree to these terms. If you do not agree, please do not use it.

2. What the Service is

The Service is a digital Diwali gift service. You buy a Gift Pack, create personalised pictures for the people you care about (or for yourself), choose a card design, add an optional short note, and send each person a private link to open their finished gift. You can also make a gift for yourself. You can buy a Gift for myself on its own, or, if you already have a Gift Pack, use one gift from your pack at no extra charge. For most gifts you can choose a ready-made note we offer as a suggestion, write your own note, or use both: your own text appears after the ready-made note. The optional “From” line (for example a person or a family name) is your own free text. It is a digital product delivered by a private link. Nothing physical is shipped.

Pictures are created with AI from the photo you provide.

3. Products and prices

Prices are in US dollars (USD) and include any tax that applies. At checkout you may see your local currency. Payment is handled by our payment provider, Stripe, and is subject to its terms. We do not see or store your full card details. All purchases are one-off. Nothing renews automatically.

A Gift for myself is a one-off purchase for yourself: one kind of picture $4.99, both kinds $6.99. It includes one free remake per gift and does not expire before you use it.

4. Gifts

• Each finished personalised picture uses one gift, from your pack or from your Gift for myself purchase. You can use the gifts in a pack for different people.
• A gift is one finished picture and card. It is not a gift card, has no cash value and cannot be exchanged for money.
• You pay once at the end. We start making pictures from your photo before you pay. Nothing is delivered until you pay, and photos from an order that is never paid for are deleted after about 24 hours.
• A gift is used only when a finished picture is delivered to you. If a picture fails for a technical reason, no gift is used.
• Each finished gift includes one free remake while its private link is valid (30 days). If your original photo has already been deleted, we will ask you to add a photo again. It goes through the same checks, at no charge. A remake does not use another gift. If a remake fails for a technical reason, your free remake is restored.
• Unused gifts do not expire. If none of your gifts has been used for 3 years, we email you and offer a refund of the unused gifts. If you don’t reply within 30 days, the unused gifts end and we delete your email address. If we ever stop offering the Service, we will refund any unused gifts.
• A pack with no delivered gifts can be cancelled within 14 days for a full refund. Once any gift from the pack has been delivered, the pack can’t be cancelled or refunded. This is explained in our Refund and Cancellation Policy.
• Gifts cannot be transferred or sold.

5. Who can buy

You must be at least 18 years old, or the age of majority where you live if that is higher, to buy. If you are younger, please ask a parent or guardian to buy it for you.

6. Your photos and notes

• You must have the right to use every photo you upload. If a photo shows another person, you must have that person’s permission.
• A photo of anyone under 18 may be uploaded only by their parent or guardian, or with a parent or guardian’s agreement. Only festive and family pictures may be made of anyone under 18. Wedding, romantic and adult-themed pictures are for adults only.
• Do not upload anything unlawful, sexual, hateful, abusive or misleading, and do not use the Service to harass anyone or to pretend to be someone else.
• Uploads are checked by an automated moderation service before they are used. If an upload is refused, no gift is used.
• You keep ownership of your photos and your own notes. You allow us to process them only so that we can provide the Service to you, as described in our Privacy Policy.

7. AI-created pictures

Pictures are created with AI from the photo you provide. Results can vary. A picture may not look exactly like the person in your photo, and we cannot promise a particular result. Each gift includes one free remake if you would like another go. Each finished picture carries the line “Created by Shubh DiwAI. AI-generated image.”

You choose the kind of picture for each person: Diwali Glamour, a festive Diwali portrait, or Manifestation, a picture of a dream such as a wedding, a holiday, a home or a drive in a car. You can make both gifts for the same person, and doing both uses 2 gifts. These pictures are creative images made with AI. They are not real photographs, and they do not show real places, homes, cars or events.

8. Private links

Each finished gift has a private link. Anyone who has the link can open that gift until it expires, so please share it only with the person it is meant for. The link and the finished picture behind it are available for 30 days from creation, then they are deleted. This does not affect your unused gifts. We cannot control a link once you have shared it.

9. Using your pictures

You may use your finished pictures for personal, non-commercial purposes, such as sending them to friends and family. You may not use them to mislead, harass or impersonate anyone, or to sell or promote anything. The Service itself, including our software, designs, card artwork and templates, belongs to NowVector Ltd or its licensors.

10. Refunds and delivery

Our Refund and Cancellation Policy and Delivery Policy form part of these terms.

If you cannot use your gifts, or a card is faulty or not as described, email support@nowvector.world with your order reference. We will fix the problem, remake the card, give you the gift back or, where the law requires, refund you. We do not use an approved alternative dispute resolution body for consumer disputes. If we cannot resolve your complaint, you may bring a claim in court as set out in section 14. This does not affect your legal rights.

11. Availability and changes

We work to keep the Service running, but we cannot promise it will always be available or free of errors. We may change or stop parts of the Service. If a change affects gifts you have already paid for, we will offer a fair solution, which may include a refund. If we stop offering the Service, we will refund any unused gifts.

12. Our responsibility

Nothing in these terms limits any right you have by law as a consumer, including your rights under the Australian Consumer Law, or any liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud. Subject to that, we are responsible for loss that is a foreseeable result of our failing to use reasonable care and skill. We are not responsible for indirect loss, or for loss caused by events outside our reasonable control. Subject to the same limits, our total responsibility to you for any one order is limited to the amount you paid for that order.

14. Governing law

These terms are governed by Scots law. If you live in the UK you may bring a claim in the courts of the part of the UK where you live. If you live elsewhere, any mandatory consumer rights of your country are not affected. If you live in Australia, nothing in these terms stops you relying on the Australian Consumer Law or bringing a claim in an Australian court.

15. Changes to these terms

We may update these terms from time to time. The version on this page when you buy is the version that applies to your order.
